Terms of Service

1. Agreement

By accessing or using Percepto AI ("Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use the Service.

2. What Percepto AI Does

Percepto AI is a voice-first AI agent that:

• Scores visitor intent from browser signals and IP geolocation
• Opens personalised voice conversations using LLM technology (Groq Llama-3.3, Anthropic Claude Haiku)
• Extracts lead summaries and pushes them to CRM systems (HubSpot, Salesforce) where configured
• Delivers text-to-speech responses via ElevenLabs

3. Data Processing Consent

By using Percepto AI, you explicitly consent to:

• Collection of browser signals (page, referrer, device, language, time) via the _scout_vid cookie
• Collection and processing of your IP address by Percepto AI and ip-api.com for geolocation
• Processing of conversation data by Groq (USA), Anthropic (USA), and ElevenLabs (USA)
• Storage of extracted lead data in Supabase (USA) for 90 days
• Transfer of your data to USA-based processors under Standard Contractual Clauses

You may withdraw consent at any time using the Decline button on our consent banner. See our Privacy Policy for full details on your rights.

4. Acceptable Use

You agree not to use Percepto AI to:

• Collect or process data of individuals under 13 years of age
• Violate any applicable laws or regulations
• Attempt to gain unauthorised access to Percepto AI systems or other users' data
• Use the Service for illegal activities, fraud, or harassment
• Reverse-engineer, decompile, or copy Percepto AI's code or models

5. Service Availability

Percepto AI is provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue the Service at any time with reasonable notice.

6. Intellectual Property

Percepto AI and all its components (code, models, brand, design) are owned by Percepto AI, Inc. and protected by applicable intellectual property laws. You receive a limited, non-exclusive licence to use the Service during your subscription.

7. Limitation of Liability

To the maximum extent permitted by law, Percepto AI, Inc. is not liable for:

• Loss of data or confidential information
• Service interruptions or downtime
• Lost revenue or business opportunity
• Any indirect, incidental, special, or consequential damages

Percepto AI's total aggregate liability shall not exceed the total amount paid by you in the 12 months preceding the claim.

8. Termination

Percepto AI may suspend or terminate your access at any time for breach of these Terms, illegal activity, or at our discretion. You may terminate your account at any time by contacting privacy@perceptoai.com.

9. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by email or by posting a notice on our website. Continued use of Percepto AI after notification constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of the United States of America. Any disputes shall be resolved by binding arbitration, except where prohibited by applicable law.
